Terms of Use

These Terms of Use ("Terms") apply to the CarbLuma app and this website, provided by ClinicalTools ("we", "us"). By downloading or using CarbLuma, you agree to these Terms. If you don't agree, please don't use the app.

1. Your licence to use the app

CarbLuma is licensed to you, not sold. Your licence to use the app is governed by Apple's Licensed Application End User License Agreement (the "Apple EULA"). These Terms add to the Apple EULA. If the two conflict, the Apple EULA controls to the extent of the conflict. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.

2. CarbLuma Pro subscriptions

Some features are available only with CarbLuma Pro, an optional auto-renewing subscription offered monthly or annually. The current price and period are shown in the app before you buy.

• Payment: payment is charged to your Apple Account when you confirm the purchase.
• Automatic renewal: your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling: you can manage or cancel your subscription in your Apple Account settings, or in the app under Settings → Subscription → Manage Subscription. Cancelling stops the next renewal; you keep Pro until the end of the period you've paid for.
• Free trials: if a free trial is offered and you start one, any unused portion of the trial is forfeited when you purchase a subscription.
• Refunds: purchases are handled by Apple, and refund requests go to Apple under its policies. We can't issue refunds directly.
• Restoring: to use Pro on another device signed in to the same Apple Account, use Settings → Subscription → Restore Purchases.
• Changes: we may change subscription features or prices. Apple will notify you of price changes as its rules require, and you can cancel before a change takes effect.

3. AI photo analysis and usage limits

AI photo analysis gives you an estimate of the carbohydrates in foods it can see in a photo. A photo can't show exact portion weights, hidden ingredients, oils, sauces or added sugars, so estimates can be inaccurate or incomplete. You are responsible for reviewing and correcting each result before you save it.

Free and Pro plans include a monthly number of AI analyses, which our server enforces. The number shown in the app is for your information. We may adjust allowances, pause the feature for maintenance, or change AI providers. The feature needs an internet connection. See our Privacy Policy for how photos are handled.

4. Medical disclaimer

• CarbLuma is not a medical device and is not intended to diagnose, treat, cure, monitor or prevent any disease or condition.
• CarbLuma does not provide medical, nutritional or dosing advice. Nothing in the app is a substitute for advice from a qualified healthcare professional.
• Do not use CarbLuma, including its AI estimates, barcode data or label readings, to calculate insulin doses or to make treatment decisions.
• Carbohydrate values from any source, including AI estimates, Open Food Facts data and label scans, may be wrong. Always check them.
• Consult your healthcare team before changing your diet, medication or treatment. In an emergency, contact your local emergency services.

5. Acceptable use

Please use CarbLuma only for its intended, lawful purpose. You agree not to:

• reverse engineer, tamper with or bypass the app's security, device verification or usage limits, except where the law allows;
• access our server other than through the app, or use automated means to send it requests;
• upload content that is unlawful or that you don't have the right to use, or photos of people without their permission;
• interfere with, overload or disrupt the service; or
• use the app or its output to build a competing service or dataset.

We may suspend AI features for an installation that we reasonably believe is misusing the service.

6. Your content

Your food log and photos remain yours. You give us permission to process a photo you submit for analysis only as needed to return an estimate to you, as described in our Privacy Policy.

7. Third-party data and services

Barcode lookups use Open Food Facts, a community database. Nutrition data from Open Food Facts is available under the Open Database License (ODbL). Product data is contributed by volunteers and may be incomplete or out of date; please check it against the package. Your use of Open Food Facts is also subject to its terms of use.

AI estimates are produced by a third-party AI provider on our behalf. Purchases, iCloud sync and device verification are provided by Apple. We aren't responsible for third-party services we don't control.

8. No warranty

To the fullest extent permitted by law, CarbLuma is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We don't guarantee that the app will be uninterrupted or error-free, or that any estimate or data will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, ClinicalTools will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of, or inability to use, CarbLuma, including any decision you make based on information in the app. Our total liability for any claim relating to CarbLuma will not exceed the amount you paid for CarbLuma Pro in the 12 months before the claim.

Some places don't allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits rights you have under consumer protection law that can't be waived.

10. Ending these Terms

You can stop using CarbLuma at any time by deleting the app. Cancelling a subscription is done through Apple, as described above. We may stop offering CarbLuma or any feature; if we discontinue Pro features you've paid for, we'll follow Apple's rules on refunds and notice.

11. Changes to these Terms

We may update these Terms. When we do, we'll post the new version here and change the "Last updated" date. If a change is significant, we'll also let you know in the app. If you keep using CarbLuma after a change takes effect, you accept the updated Terms.
